Title A name given to the resource Представництво потерпілих перед Міжнародним кримінальним судом Description An account of the resource Римський статут прямо передбачає участь потерпілих у судовому процесі. Водночас, правові інструменти Суду не містять чіткого визначення формату такої участі. Згідно з правилом 89(1) Регламенту процедури і доказів, «[с]клад суду визначає провадження та спосіб, у який участь [потерпілих] вважається доцільною». Крім того, стаття 68(3) Римського статуту встановлює, що «[у] разі, коли особисті інтереси потерпілих зачіпаються, Суд дозволяє викладати та враховувати їхні погляди та занепокоєння на стадіях провадження, які Суд вважає доцільними, і в спосіб, який не шкодить правам обвинуваченого та справедливому і неупередженому судовому розгляду». Перші провадження перед Судом продемонстрували, наскільки складною є ця правова конструкція, та що ефективна участь потерпілих значною мірою залежить від того, як положення правових актів тлумачаться Палатами. Питання про мету участі потерпілих у контексті процедур Міжнародного кримінального суду та про те, як її слід реалізовувати, щоб забезпечити реальну ефективність, залишається відкритим для подальшого вивчення. Метою участі потерпілих має бути врахування тих чинників, які послідовно визначаються як важливі для потерпілих, та вироблення способів задоволення інтересів якомога більшої кількості з них. Огляд наявної літератури з цього питання свідчить, що серед найважливіших інтересів потерпілих у взаємодії з системою кримінального правосуддя — окрім права на відшкодування — є право на отримання інформації щодо власної справи. Потерпілі також цінують поінформованість і чіткість щодо своєї ролі у кримінальному провадженні, що дозволяє уникнути хибних сподівань і очікувань, які не можуть бути реалізовані або які залишають почуття розчарування. Ще одним ключовим інтересом потерпілих є повага з боку системи. Нарешті, загальновизнано, що потерпілі частіше задоволені кримінальним процесом, якщо вони відчувають, що їхній голос було почуто. Title A name given to the resource No time to wait: Realising Reparations for Victims before the International Criminal Court Description An account of the resource In February 2018, REDRESS began a review of the system of reparations at the ICC with the kind support of the Ministry of Foreign Affairs of Finland. Over a period of 10 months, the REDRESS team conducted research and extensively reviewed ICC filings, decisions, and policy documents as well as journal articles on ICC reparations. We also interviewed ICC staff; the Executive Director, Chair of the Board and staff of the TFV; Legal Representatives of Victims; legal experts; academics and representatives of civil society. In October 2018, REDRESS convened an Expert Roundtable meeting on reparations in The Hague. Participants included staff of the ICC Registry, Office of the Prosecutor, legal representatives of victims (legal representatives), Office of Public Counsel for Victims (OPCV), case managers, academics, legal experts from the Democratic Republic of Congo (DRC), and representatives of civil society organisations. In addition, in December 2018, REDRESS organised a side-event on reparations during the 17th Assembly of States Parties (ASP) meeting in The Hague co-hosted by Finland, Sweden, Switzerland and Chile. The rich discussions from both events have informed the findings and recommendations for this report. The report was prepared by Lorraine Smith van Lin, REDRESS Legal Adviser. У цій книзі 11 українок різних професій і з різних регіонів розповідають про пережитий травматичний досвід війни. Історії охо- плюють події з 2014 та з 2022 років. Авторки щиро та відверто написа- ли про життя в російській окупації, втрату через війну рідних, майна та здоров’я, полон, сексуальне та гендерно зумовлене насилля, пов’я- зане з війною, тощо. Вагомою частиною їхніх історій є розповіді про те, що їх підтримувало під час цих потрясінь і продовжує допомагати переживати травматичний досвід війни. Підсумком видання є розділ від психологині, присвячений питанням відновлення.
